Medicaid Book Continues to Grow on EZElderLaw

Some of our followers know we’ve been building an educational website called EZ Elder Law. We started this project almost three years ago and it went live in March of 2021. We know it takes time to build something this large, so it has always been viewed as a 10 year project. The purpose of the website is to provide information to the public, but also to serve as a resource for younger lawyers and for lawyers who have questions about Elder Law. One of the features we are building is our Medicaid Book. Yesterday, we added a post discussing how Medicaid views burial resources and life insurance.

Recently I took a call from another attorney asking about term life insurance policies. The attorney’s client had term policies with a significant face value, but with no cash value. The question was, do we have to get rid of the policies? The answer is “no.” Under both Georgia’s rule and the POMS, a term life policy with no cash value is not a resource. See Georgia ABD 2323-1; POMS SI01130.300.C.1.

As EZ Elder Law grows, we hope you find it helpful. We also hope other Elder Law Attorneys will begin contributing their insight. If you have questions about Elder Law, we’ve probably written something about them already. We built the website, initially, with general information. As it has grown, we’ve gone back and provided additional substance with links to source materials. Although you will find some information using the site map, we recommend that you use the search feature because most of the new pages were posted as blog articles. If you have questions, or if you want us to address an issue we haven’t touched on already, you can contact us via email at david@ezelderlaw.com.
