Information on this site does NOT and/or links on this site do NOT constitute legal advice, financial advice, and/or other advice.  You may NOT rely on information found on this site as if it was specific advice from David L. McGuffey and/or the Elder Law Practice of David L. McGuffey, LLC. Information linked to/from this site does not necessarily reflect the opinions of David L. We are pleased to communicate with you by e-mail. If it is addressed to us, your email communication should be protected by the Electronic Communications Privacy Act, 18 U.S.C. §§ 2510-2521. However, please remember that internet e-mail is not secure.  You should avoid sending us sensitive or confidential internet e-mail messages unless they are adequately encrypted.  Also, if we do not presently represent you on the matter described in your message, we make no representation or agreement that we will represent you and what you send may not be protected by any privilege. IN OTHER WORDS, DO NOT SEND US CONFIDENTIAL INFORMATION IF WE DO NOT CURRENTLY REPRESENT YOU. We are pleased to discuss matters generally, but do not send confidential information on those services. Instead, either call us or send us regular email.

Our policy is that the Elder Law Practice of David L. McGuffey will not agree to provide legal representation for ANYONE until we speak with you and confirm that (i) we do not have a conflict of interest and (ii) that we can assist you. In that regard, we do not represent persons on matters outside of Georgia and Tennessee without associating a local attorney who would serve as your primary attorney for matters unique to that jurisdiction. Once we have confirmed that we can help you, our policy is that we require a written agreement between you and our firm outlining the scope of our representation. That way, both of us know the scope of our work on your behalf. WE ARE NOT YOUR ATTORNEYS AND WILL TAKE NO ACTION TO REPRESENT YOU UNTIL YOU HAVE SIGNED AND RETURNED THE WRITTEN FEE AGREEMENT RELATING TO YOUR CASE. Please contact us if you would like to review our fee agreement in advance or if you have any questions concerning what we can (or cannot) do to help you.

We do not promise specific results in any case. There are too many hazards in the law, and it changes too frquently for us to tell you what the future holds for your case. Instead, if you retain us and if we agree to represent you, then we promise that we will represent you vigorously and zealously, within the bounds of law and the canons of legal ethics. Within those bounds, we will do everything in our power to help you achieve your goals.

While our goal in creating this web site was to provide you with a general information resource and a community reference for Georgia and Tennessee communities, in  some jurisdictions this web site may be considered advertising.  You should keep in mind that the hiring of a lawyer is an important decision.  Your decision should not be based solely upon written information about our qualifications and experience. Certainly, it should not be based on the design of this or any other web site.  To the extent the State Bar Rules in your jurisdiction require us to designate a principal office and/or a single attorney responsible for this web site, our Elder Law Practice & McGuffey designates its office 202 W. Crawford Street, Suite B, Dalton, Georgia 30720 (U.S.A.) as its principal office and designates David L. McGuffey as the attorney responsible for this web site.

In that regard, "Elder Law" is a field where attorneys may be certified as specialists in Tennessee; Mr. McGuffey is Certified as an Elder Law Attorney by the National Elder Law Foundation and as an Elder Law Specialist by the Tennessee Commission on Continuing Legal Education and Specialization. Mr. McGuffey is certified as a Civil Trial Specialist by the Tennessee Commission on Continuing Legal Education and Specialization. The Georgia Bar Association does not currently certify attorneys as specialists.
